The U.S. General Services Administration (GSA) recently initiated its Water Testing Modification Effort to ensure the quality of drinking water in properties leased by GSA. Starting in February 2024, GSA began issuing unilateral lease amendments (ULAs) to landlords, requiring them to conduct one-time drinking water testing within the leased spaces and building common areas. This initiative addresses concerns over water stagnation and potential Legionella bacteria growth. Landlords must complete the testing according to a prescribed scope of work and report the results to GSA within 90 days of receiving the amendment.
GSA covers the cost of baseline water testing up to $3,500, but landlords must hire a qualified inspector and immediately implement corrective actions for any exceedances of drinking water standards. The required testing includes lead, copper, total coliform, and Legionella bacteria. Landlords are being notified in phases, with nearly 3,000 leases affected in the initial stages. Time is critical, and landlords must retain knowledgeable environmental consultants or water testing companies to expedite the process and ensure compliance.
